NOTICE UNDER SECTION 106 TPA (EVICTION NOTICE)

Sir,

This notice is issued on the instruction of our client, Mr. M, son of Mr. N, and we hereby inform you of the following:

  1. You are currently in occupation of the premises located at the Ground Floor of Villa No. 12, Sector 44, Noida, measuring 700 sq. ft., for residential use. These premises were let out to you, and you are holding them as a tenant under our client for a monthly rent of Rs. 75,000.
  2. Your tenancy agreement was for a duration of three years, which expired on the 30th day of June 2024. Despite the expiration, you have failed to return the vacant and peaceful possession of the said premises to our client.
  3. Our client, the owner of the aforementioned property, no longer wishes to continue the tenancy. Therefore, acting on our client's instructions, we hereby provide you with notice that your monthly tenancy concerning the said property will be terminated upon the expiry of 15 days from your receipt of this Notice.
  4. Consequently, on behalf of our client, we demand that you quit, vacate and deliver up vacant and peaceful possession of Villa no. 12, Sector 44, Noida, within 15 days from your receipt of this Notice. The property must be returned to our client in the same condition it was in when provided to you in 2021.
  5. Should you fail to quit, vacate and deliver up vacant and peaceful possession of the said premises within 15 days from the receipt of this Notice, you shall be considered a trespasser. In such an event, our client will initiate appropriate legal proceedings against you for the recovery of vacant possessionand other reliefs. Be advised that you will be held liable for all associated costs and expenses.
  6. This communication constitutes a formal Notice under Section 106 of the Transfer of Property Act 1882.
